This website is operated by Highvendor LLC. Throughout the site, the terms “we”, “us”, “our” and “company” refer to Highvendor. The terms of service stated herein constitute a legal agreement between you and Highvendor. In order to use highvendor.com, you must agree to the Terms of Service that are set out below. By using or receiving any services supplied to you by the highvendor.com, you hereby expressly acknowledge and agree to be bound by the terms of service of the Agreement, and any future amendments and additions to this Agreement as published from time to time at the highvendor.com.

THE COMPANY IS NOT A MEDICAL CANNABIS COLLECTIVE OR COOPERATIVE (“DISPENSARY”) AND DOES NOT ITSELF PROVIDE MEDICAL CANNABIS DELIVERY SERVICES TO MEDICAL CANNABIS PATIENTS. THE COMPANY DOES NOT PROVIDE OR SELL MEDICAL CANNABIS AND IS NOT A MEDICAL CANNABIS DELIVERY SERVICE PROVIDER. HIGHVENDOR OFFERS ONLINE PLATFORM FOR USERS TO OBTAIN DELIVERY SERVICES FROM THE THIRD PARTY DISPENSARIES. THE COMPANY DOES NOT INTEND TO PROVIDE DELIVERY SERVICES OR ACT IN ANY WAY AS A DELIVERY SERVICE PROVIDER.

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

By using the Service, you represent and warrant that you are at least 18 years old. By using the Service, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by the terms of service of this Agreement. Your participation in using the Service is for your sole, personal use. You may not authorize others to use your user status, and you may not assign or otherwise transfer your user account to any other person or entity. When using the Service you agree to comply with all applicable laws from your home nation, country, state and city in which you are present while using the Service.

By using the Service, you agree that:

You will only use the Service for lawful purposes; you will not use the Services for fraudulent purposes.
You will not try to harm the Service in any way whatsoever.
You will not copy, or distribute the Service or other content without written permission from the Company.
You will only use the Service for your own use and will not resell it to a third party.
You will keep secure and confidential your account password or any identification we provide you which allows access to the Service.
You will provide us with whatever proof of identity we may reasonably request.
You will at all times act in full compliance with the laws of your State pertaining to medical (or the recreational use of) cannabis collectives and/or cooperatives.

ACKNOWLEDGMENT OF CALIFORNIA LAW

User expressly acknowledges that the use, possession, cultivation, transportation and distribution of cannabis is illegal in California unless all participants are acting completely within the scope of California’s medical cannabis laws as set forth in the Attorney General’s Guidelines for the Security and Non-Diversion of Marijuana Grown for Medical Use (August 2008) and the Medical Marijuana Regulation and Safety Act (consisting of AB243), AB266 and SB643 and any amendments thereto.

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall highvendor.com, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
